Business Listing Terms and Conditions

1. Introduction

The website fiserent.com (hereinafter the "Platform") was created and is managed by the sole proprietorship "ROUSSOS PANTELEIMON PETROS", VAT No.: 164711938, headquartered in Syros, 11 Athanasiou Diakou Street, 84100 (hereinafter "Fiserent").

This document (hereinafter the "Agreement") encompasses all terms and conditions governing the relationship between Fiserent and you (hereinafter the "Lessor") with respect to your listing on the Platform and the rental of your vehicles through it.

Please read this Agreement and the Privacy Policy carefully before you begin using the Platform as a Lessor.

2. Lessor Registration

Only registered Lessors may make use of Fiserent's listing services. Each Lessor creates their professional account free of charge by completing the required details.

Upon registration, the Lessor must register their bank account and submit the necessary documentation (such as the Certificate of Compliance with Legal Requirements for a vehicle rental business). The Lessor must also send Fiserent the Rental Agreement they use.

Fiserent reserves the right, at its absolute discretion, to reject or cancel a Lessor's registration.

Upon completion of registration, the Lessor will be able to create their professional profile, update their vehicle list and prices, access booking statistics, and upload promotional material.

3. Financial Terms

Lessor registration on the Platform is free of charge. Fiserent charges only a commission per transaction:

  • 15% (+VAT) on the booking amount for bookings made entirely through the Platform
  • 5% (+VAT) on the booking amount for bookings via referral of the renter to the Platform by the Lessor (using a hyperlink)

Commissions are calculated only on the rental amount and not on any deposit. Payment to the Lessor is made within the first ten (10) days of each month for rentals that took place during the previous month.

Fiserent reserves the right to unilaterally increase its commission with thirty (30) days' prior written notice to the Lessor.

Optionally, in the event of a financial dispute with a renter that cannot be covered by a deposit, the Lessor may request that Fiserent retain the relevant amount from the renter's card. In this case, handling fees are charged: a) €5.00 (+VAT) for a claim up to €24.99, b) €10.00 (+VAT) for a claim of €25.00–€49.99, c) €15.00 (+VAT) for a claim ≥€50.00.

4. Vehicle Deliveries and Returns

When a Vehicle is booked, the Lessor is notified of the booking and renter details. If the renter fails to show up, the Lessor must attempt to contact them. If contact cannot be established, the Lessor may assign the Vehicle elsewhere after a reasonable period of time.

Upon return of a Vehicle without damage and with the same fuel level, the Lessor selects "Release" on the Platform to return the deposit. In the event of damage or shortfalls, the Lessor notifies Fiserent with detailed documentation of their claim.

5. Lessor Obligations

Throughout the duration of this Agreement, the Lessor declares and warrants that:

  • They operate as a sole trader or are the legal representative of a company legally operating in Greece
  • They meet all requirements for practising their profession and hold all necessary legal licences
  • The information provided about Vehicles, prices and availability is truthful and up to date
  • All Vehicles are insured, legally registered, in good mechanical condition and safe
  • They will strictly comply with the terms of each booking and Rental Agreement
  • They will deliver exactly the agreed Vehicle without hidden charges
  • They will always issue the legally required fiscal document to renters
  • They will not circumvent Fiserent by encouraging transactions outside the Platform

6. Fiserent's Rights

Fiserent reserves the right to use the Lessor's details for the purposes of the Platform, to refuse registration, to request updated documentation, to suspend and/or delete an account in the event of a breach, and to remove false or misleading material.

7. Reviews

Users may submit reviews of Lessors. The Lessor understands that Fiserent will not remove negative reviews that do not violate the Terms.

8. Security and Functionality

We make every effort to continuously improve the user experience. However, we cannot guarantee that use of the Platform will be uninterrupted or error-free. The Lessor is responsible for maintaining the security of their login credentials.

9. Intellectual Property

"Fiserent" is a registered trademark (OBI filing No.: N298224 and EUIPO filing No.: 019331644). The Lessor grants Fiserent a licence to use the material they upload to the Platform for the purposes of their listing, for the duration of this Agreement.

10. Confidentiality

Both Fiserent and the Lessor are obliged to treat as strictly confidential any information obtained within the framework of this Agreement. Confidentiality obligations apply for a period of five (5) years after the completion or termination of the Agreement.

11. Indemnification

The Lessor agrees to indemnify Fiserent against any third-party claim arising from a breach of this Agreement, including, by way of example, defamation, copyright infringement or false advertising.

12. Disclaimer of Liability

Fiserent's services are provided "as is", without any guarantee as to their effectiveness or their ability to meet the Lessor's expectations. Registration on the Platform is not associated with any sales target or customer growth objective. Under no circumstances may Fiserent be held liable for any consequential or indirect damage suffered by the Lessor.

13. Duration and Termination

This Agreement automatically comes into effect upon the Lessor's registration and remains in force until the deletion of their account or its termination. The Lessor has the right at any time to delete their account, provided that any pending bookings are completed normally.

14. Entire Agreement

This Agreement constitutes the entire agreement between Fiserent and the Lessor and supersedes any prior arrangements.

15. Partial Invalidity

If any provision is found to be unlawful or unenforceable, the remaining provisions shall remain in full force.

16. No Waiver

Any failure or delay by Fiserent to enforce any provision shall not be construed as a waiver.

17. Governing Law and Jurisdiction

This Agreement is governed by the laws of Greece. The competent Courts of Ermoupolis, Syros are designated as the courts of jurisdiction.

18. Amendments

Fiserent reserves the right to unilaterally modify the terms of this Agreement, notifying the Lessor in advance by email. Continued use of the Platform after amendments constitutes unconditional acceptance thereof.
