1. Introduction

The website fiserent.com (hereinafter the "Platform") was created and is managed by the sole proprietorship "ROUSSOS PANTELEIMON PETROS", VAT No.: 164711938, headquartered in Syros, 11 Athanasiou Diakou Street, 84100 (hereinafter "Fiserent", "we", "us") and constitutes an online search and matching platform through which users can search for vehicles (cars, motorcycles, e-bikes, etc.) offered for short-term rental by licensed businesses listed on the Platform, compare available options, and make their booking through the Platform with ease, speed and transparency.

This document (hereinafter the "Terms of Service") constitutes a binding agreement encompassing all terms and conditions governing the relationship between Fiserent and you (hereinafter the "User", "you") with respect to your browsing of the Platform and your use of the provided services.

Please read these Terms of Service carefully as well as the Privacy Policy, before you begin using the Platform. Your registration on the Platform and use of its services implies your unconditional acceptance of these Terms of Service and the Privacy Policy as in force from time to time.

2. Minors

Use of the Platform and our services is permitted exclusively to Users who have reached the age of 18. By accepting the Terms of Service the User declares that they are an adult, over 18 years of age or, if under 18, that they have obtained the necessary consent from all persons with parental responsibility and will provide their details if requested. We reserve the right to take all reasonable technical measures and to prohibit access to the Platform to any User found to be in breach of this provision.

3. User Registration

Users who wish to access Fiserent's services must create their account on the Platform by completing the required details for identity verification.

Among the documents that will be requested from the User is a valid driver's license certifying the User's ability to drive the selected vehicle. The User is solely responsible for providing and maintaining a valid driver's license, including any International Driving Permit (IDP), in accordance with applicable law. Fiserent will have the ability to verify the validity of the submitted driver's license and to reject the User's registration if the license does not meet legal requirements for any reason.

Registration on the Platform and use of the provided services is free of charge. The User is only charged the amount set by the respective vehicle rental business (hereinafter the "Lessor") for the rental of the corresponding vehicle selected by the User (hereinafter the "Vehicle").

4. Services and Fiserent's Role

The Platform constitutes an online space for searching and finding businesses and facilitating agreement with them. Fiserent merely provides the infrastructure for making bookings and is not the provider of the services accessed by the User through the Platform, nor is it legally connected in any way to the Lessors listed on the Platform. These Terms of Service apply exclusively to the relationship between Fiserent and the User with respect to the proper use of the Platform.

The rental of the Vehicle constitutes a contractual relationship exclusively between the User and the Lessor, the terms and conditions of which are governed by the relevant agreement that the User will sign upon collection of the Vehicle (hereinafter the "Rental Agreement"). The User will have the opportunity to read the Rental Agreement before completing the booking. Upon completion of the booking, the User declares and accepts that they have understood the terms of the Rental Agreement and that, in the event of non-compliance with these terms, the Lessor will have all rights granted to it under the agreement and applicable law, including the right to withdraw from the booking.

5. Vehicle Booking

To make your booking for a Vehicle through the Platform, you must fill in the basic rental details (vehicle, rental days, pickup and return date and time, etc.) in accordance with the relevant instructions. Once you have completed your booking, we will transmit the booking details, your contact information and the license you have uploaded to the Platform to the Lessor.

Fiserent contractually obliges Lessors and makes every reasonable effort to ensure that the Vehicles listed on the Platform correspond to their stated specifications. However, if the Vehicle you have collected does not correspond to your booking, please notify us immediately so that we may mediate to find the best solution.

The completion of your booking is effected upon payment of the rental amount and any deposit as determined by the respective Lessor. Payment is made exclusively by credit or debit card through the payment service provider Stripe Inc.

Upon completion of the booking, the User expressly authorises Fiserent, acting on behalf of the Lessor, to store and use their payment card details for subsequent charges in the following circumstances: damage or deterioration to the Vehicle, fuel shortage, fines, toll charges or other charges provided for in the Rental Agreement. The User retains the right to dispute any charge in accordance with applicable law.

6. Vehicle Collection

The User must be at the Vehicle collection point at the exact date and time stated. In the event of an anticipated delay, for any reason, the User must notify the Lessor in a timely manner. In case of delay without prior notification, the Lessor will have the right, at their absolute discretion, to assign the Vehicle elsewhere.

Upon collecting the Vehicle, the User is encouraged to ask the Lessor about pre-existing damage and to take photographs confirming the condition in which the Vehicle was collected.

7. Vehicle Use

Use of the Vehicle is governed exclusively by the Rental Agreement and applicable law. The User understands and accepts that the Rental Agreement includes obligations such as, among others:

  • Driving the Vehicle only by the User or an authorised driver
  • Prohibition on driving outside designated zones or off paved roads
  • Maximum mileage limits without additional charge
  • Obligation to return the Vehicle with the same fuel level
  • Prohibition on driving under the influence of alcohol, drugs or other substances
  • Compliance with the Highway Code
  • Obligation to immediately notify the Lessor in the event of an accident
  • Responsibility for fines and traffic violations while driving

8. Vehicle Return

The User must return the Vehicle on the agreed date and time, in the condition in which it was collected. Upon return, the Lessor will inspect the Vehicle in the presence of the User for any damage or fuel shortage.

If the Vehicle shows no damage and is returned with the same fuel level, any deposit paid will be returned to the User within ten (10) business days.

9. Cancellations and Booking Modifications

Users may modify or cancel their booking exclusively within the predetermined time period set by the respective Lessor. If the User cancels their booking in time, the full amount will be refunded within ten (10) business days.

Each Lessor's cancellation policy is visible to the User when making the booking.

10. Acceptable Use

Users must use the Platform and provided services in a lawful and fair manner. In this context, Users are prohibited from, among other things: using malicious software, posting illegal content, using false information, abusing the services, creating multiple accounts with fraudulent intent, accessing other Users' accounts, infringing intellectual property rights, and any other use contrary to these Terms of Service and applicable laws.

11. Reviews

Users may submit reviews regarding Lessors. Reviews must be truthful, accurate and based on personal experience. Posting false, misleading, abusive or defamatory reviews is prohibited.

12. Third-Party Websites

The Platform may provide links redirecting to third-party websites. Fiserent does not guarantee the security or validity of these pages. Access to them is entirely at the User's own risk.

13. Security and Functionality

We make every effort to continuously improve the User experience. However, due to the nature of the internet, we cannot guarantee that use of the Platform will be uninterrupted, secure or error-free. The User is solely responsible for maintaining the security of their personal login credentials.

14. Platform Content

The content of the Platform and the services of Fiserent are provided to Users "as is". Fiserent reserves the right at any time to modify the structure, content, features and provided services without prior notice. The User is solely responsible for the reliance placed on the information contained on the Platform.

15. Intellectual Property

"Fiserent" is a registered trademark (OBI filing No.: N298224 and EUIPO filing No.: 019331644). All content of the Platform constitutes intellectual property of Fiserent and is protected by relevant provisions. The User has no right to reproduce, copy or commercially exploit the content of the Platform without prior consent from Fiserent.

16. Indemnification

You agree to indemnify and hold Fiserent harmless against any third-party claim arising out of or in connection with your violation of these Terms of Service, the Privacy Policy and/or any applicable law.

17. Limitation of Liability

Fiserent disclaims all liability for Lessor breaches, damages related to the use of Vehicles, damages from Platform unavailability, and any other indirect damage. Under no circumstances may the listing of a Lessor on the Platform be construed as implying any legal connection between Fiserent and that Lessor.

18. Duration and Termination

These Terms of Service automatically come into effect upon any User's visit to the Platform. Fiserent reserves the right to terminate and suspend and/or discontinue the provision of its services to any User who violates these Terms of Service.

19. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Greece. The competent Courts of Ermoupolis, Syros are designated as the courts of jurisdiction for the resolution of any dispute.

As consumers you also have the right to out-of-court dispute resolution in accordance with Regulation (EU) 524/2013. For more information: consumer-redress.ec.europa.eu.

20. Partial Invalidity

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, the remaining provisions shall remain in full force.

21. No Waiver

Any failure or delay by Fiserent to enforce any provision of these Terms of Service shall not be construed as a waiver.

22. Special Terms

Where the use of any service of the Platform is governed by more specific terms, these shall be considered as a single whole with these Terms of Service. In the event of conflict, the more specific terms shall prevail.

23. Amendments

Fiserent reserves the right to modify these Terms of Service at any time. Continued access to the Platform will be deemed as unconditional acceptance of the relevant changes. The date of the last amendment is always shown at the top of this page.
